APPLICANT REQUESTS THAT:
His DD Form 214, Certificate of Release or Discharge from Active
Duty, be corrected to reflect that he is a Vietnam Era Veteran
and that he receive a Vietnam Campaign Ribbon or Medal.
APPLICANT CONTENDS THAT:
He is trying to go to school and needs documentation stating
that he is a Vietnam Veteran. When he was discharged in Feb 83,
his original DD 214 reflected Vietnam Era Veteran. The 355
Tactical Wing that he served with at Davis Monthan AFB from
1974-1979, received the Vietnam Campaign Citation.

STATEMENT OF FACTS:
The applicant initially entered the Regular Air Force on
10 Dec 74.
On 14 Feb 83, the applicant was furnished an honorable
discharge, and was credited with eight years, two months, and
five days of active service.
The remaining relevant facts pertaining to this application are
contained in the memorandum prepared by the Air Force office of
primary responsibility (OPR), which is attached at Exhibit C.
AIR FORCE EVALUATION:
AFPC/DPSID recommends denial indicating there is no evidence of
an error or an injustice. A thorough review of the applicants
official military personnel record did not reveal any
documentation that substantiated that he served in the area of
eligibility for award of the Vietnam Service Medal (VSM) or the
Republic of Vietnam Campaign Medal (RVCM). The applicants
dates of service (1974 through 1983) were outside the award
inclusive dates for either the VSM or RVCM, which were
authorized from 1 Mar 61 through 28 Mar 73 and 29 Jan 73 through
28 Mar 73, respectively. Furthermore, the RVCM is awarded on an
individual basis of being in the area of eligibility during the
award inclusive period for an aggregate of six months and would
not be issued to an entire wing as the applicant states in his
request unless the entire wing was serving in the area of
eligibility during the award inclusive period and met the award
criteria. To grant relief would be contrary to the eligibility
criteria established by DoDM 1348.33, Secretary of the Air
Force, Chief of Staff, and/or the War Department.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 28 Jul 14 for review and comment within 30 days
(Exhibit D). As of this date, no response has been received by
this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicants complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
(OPR) and adopt its rationale as the basis for our conclusion
the applicant has not been the victim of an error of injustice.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting the relief sought in this
application.
THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.

As for his request for the VSM or AFEM, a review of the applicants records revealed that he should have been awarded the VSM and the Republic of Vietnam Gallantry Cross with Palm (RVGC w/P) and his records will be corrected administratively.
